Read the following Privacy Policy carefully as it sets out your rights in relation to the processing of your personal data. We have prepared this policy based on the provisions of the General Data Protection Regulation No. 679/2016, the so-called GDPR.

Who is responsible for the processing of your personal data?

AlohaCamp is responsible for the processing of your data, being the so-called personal data controller. Our formal, official name is AlohaCamp S.A. with its registered office in Warsaw at PuΕ‚awska 77, premises U.5, 02-595 Warsaw (β€œWe,” β€œAlohaCamp”).

We will respond to your question regarding the processing of your personal data within the deadlines and in accordance with the requirements under the GDPR.

Why and on what legal basis do we process your personal data?

  • If you are a host, you are entering into an agreement with us to publish information about your property on our Website and to allow guests to book your services through AlohaCamp:

    1. We process your personal data to perform the agreement concluded with us and to enable the publication of information about your property on the Website and enable our users to find information about you.

    2. In addition, we process your data in order to enable our users to book the services provided by you, to contact you, to enable you to make payment for the services and to carry out other activities related to the contract concluded with us.

    3. We also process your personal data in order to improve the quality of our services.

    4. In addition, in connection with the contract, we process your personal data for the purposes of billing, invoicing, bookkeeping and reporting required by law.

    5. We may also process your personal data for the purpose of promoting our products and services, as well as to promote your property. For this purpose, we use various marketing tools, including: contextual advertising, search engine advertising and so-called influencer marketing. As part of this processing, we may transfer your personal data to entities that provide marketing services to us. Please see "Do we pass your data to other parties?" below for more information.

    6. We will also process your personal data for the purpose of handling complaints or pursuing claims.

    7. All purposes for processing your personal data find their legal basis in Article 6(1)(b), (c) and (f) of the GDPR.

    8. Additionally, if you have consented to the processing of your personal data for marketing purposes, we will process your personal data on the basis of Article 6(1)(a) of the GDPR.

  • If you are a user of our Website:

    1. We process your personal data to enable you to create an account on our Website, make reservations for services of your choice, process payments for those services and contact the host.

    2. We also process your personal data to improve the quality of our services and to enable you to add feedback on our Website.

    3. In addition, we process your personal data in relation to this agreement for billing, invoicing, accounting and reporting purposes as required by law.

    4. We will also process your personal data for the purpose of handling complaints or asserting claims.

    5. All purposes for processing your personal data find their legal basis in Article 6(1)(b), (c) and (f) of the GDPR.

    6. Additionally, if you have consented to the processing of your personal data for marketing purposes, we will process your personal data on the basis of Article 6(1)(a) of the GDPR.

Does AlohaCamp pass on the personal data of the user who has booked services with the Host?

If you book travel services offered on the Website by hosts, we will provide the host you have selected with the following information:

  • your name,

  • your telephone number,

  • the date of your stay at the property and the time of your planned arrival,

  • the range of services you will benefit from,

  • information about the payment made,

  • the number of people who will accompany you,

  • your special requests regarding the services provided or other information you choose to provide to the Host.

The transmission of your personal data to the Host is necessary in order for the Host to be able to handle your booking and prepare accordingly. We do not provide the Host with any personal information other than that indicated above.

    • informing our users of changes to the Website, including changes to the Terms and Conditions and Privacy Policy.

    The basis for the processing of personal data for the above purposes is our legally justified interest, which is based on Article 6(1)(f) of the GDPR.

Where have we obtained your personal data from?

If you are a User who uses our service, we have obtained personal data directly from you. In doing so, we always adhere to the principle of minimisation under Article 5(1)(c) of the GDPR and only process personal data that is necessary for the provision of our services and for the other purposes set out more broadly above in this Policy.

If you are a Host, we have obtained your personal data directly from you. In order to confirm the accuracy of this data, we may have verified it with publicly available sources such as CEIDG, KRS or GUS. To a certain extent, we were also able to obtain your personal data from other publicly available sources, which allowed us to make contact with you.

What rights do you have in relation to the processing of your personal data?

In accordance with the GDPR, whether you are a Host or a User of our Service you have the following rights in relation to AlohaCamp's processing of your personal data:

  • You have the right to receive information regarding the processing of your personal data (in particular, information on the purpose, what data and by whom it is processed and to whom it is made available, you also have the right to request information on how long your data will be processed). This privacy policy is an exercise of your right to information.

  • You have the right to lodge a complaint against processing of your data and you may lodge a complaint with the Office for Personal Data Protection, Stawki 2 Street, Warsaw, Poland (https://uodo.gov.pl/).

  • You have the right to receive a copy of your data that is processed.

  • You have the right to request removal of your personal data (if you believe we have no right to process it) or to object to the processing.

  • You may also request that we restrict the processing of your personal data.

  • You have the right to request rectification or correction of your personal data.

  • You also have the right to portability of your personal data.

How long will we process your personal data?

We will process your personal data for the period necessary for the purposes mentioned above and until we comply with the legal obligations imposed on us. As a general rule, we will process personal data for 6 years after the end of the legal relationship between AlohaCamp and the user or host. This period is justified by the applicable statute of limitations for civil and tax claims in Poland. More detailed information is available below:

Do we share your data with other parties?

If you are our user and you book services with a Host, we will pass on your data to the Host in accordance with the scope indicated in the section "Does AlohaCamp pass on the personal data of the user who has booked services with a Host?". This is necessary for the booking process and its subsequent handling.

If you are a host, we will post data about your business and services on our Website, where it will be publicly available.

In addition, we may also disclose personal information to the extent limited and necessary:

  • Companies that provide us with a variety of services such as server maintenance, provision of IT solutions or business consulting,

  • If you are a Host, we may pass on your data to entities that provide marketing services to us such as search engines, marketing agencies or influencers who, with your consent, stay at your property to promote your property

  • Law firms and audit firms,

  • Banks or payment operators.

Do we transfer your data outside the European Economic Area (EEA)?

We use various service providers to provide us with the services set out above. Some of these providers are based outside the EEA. This means that in certain situations we may transfer data outside of the EEA if it is required for the performance of the services provided to us. However, where this is the case, we will always ensure that the transfer of data takes place in accordance with the mechanisms set out in the GDPR.
