Outdoors Club Program Terms and Conditions

§1 General statements

  1. These Regulations (the “Regulationsˮ) define the rules of participation in the Outdoors Club Program (the “Programˮ).
  2. The organizer of the Program is AlohaCamp S.A. with its registered seat in Warsaw, ul. Puławska 77 lok U.5, 02-595 Warsaw, KRS number 0000922633 (“AlohaCampˮ or “Organizerˮ).
  3. The program runs from 1.01.2025 until cancellation. AlohaCamp reserves the right to suspend or terminate the Program at any time without giving any reason and to modify the Program rules. This does not affect the rights acquired by the Program Participants.
  4. The terms used below have the following meanings:
    1. User - an individual with an account on the alohacamp.com platform,
    2. Participant - a user who meets the conditions for participation in the Program specified in these Regulations,
    3. Host - provider of travel services such as hotel services, other accommodation services, sightseeing services, or services of discovering interesting places presenting their offers on the alohacamp.com website and allowing bookings to be set up through this platform,
    4. Platform - alohacamp.com online service operated by the Organizer that allows making reservations for stays with Hosts.

§2 Program participation and its rules

  1. The Program may be attended as a Participant by a User who is a natural person with full legal capacity, who will jointly meet the following conditions:
    1. has an active User account on the alohacamp.com platform,
    2. will accept these Terms and Conditions, with the proviso that persons who are Users of alohacamp.com Platform with active marketing consent as of 26.12.2024 are assigned to the Program with the possibility of resignation according to the information provided by the Organizer (so-called opt-out),
    3. will give marketing consent to be contacted by the Organizer (does not apply to persons described in point b).
  2. If the User fulfills the conditions of participation in the Program, he/she will receive access to the Club Discounts (“Discountsˮ) described in §3.
  3. The Participant may, at any time and without giving any reason, resign from participating in the Program by:
    1. deleting the Account on alohacamp.com following its Terms and Conditions,
    2. canceling the marketing permission,
    3. submitting a cancellation of participation in the Program via the User's account on the Platform at: https://alohacamp.com/account/notifications
  4. If even one of the prerequisites from §3 is met, the Participant's participation in the Program is terminated.
  5. Participation in the Program is free of charge.
  6. The Organizer reserves the right to exclude from the Program Participants who break the regulations of the Terms and Conditions or take actions contrary to the rules of social intercourse or engage in manipulation.

§3 Club Discounts

  1. Participants receive access to Club Discounts offered by Hosts. Unless otherwise specified, Discounts are granted on the booking price specified by the Host.
  2. The Host may not require the Participant to pay a surcharge for benefits booked through the Platform if their scope and nature are identical to what was booked through the Platform. However, the Host may demand payment for benefits that the Participant has purchased on-site from the Host or if the Participant requests additional benefits that were not the subject of the reservation.
  3. A change in the date and scope of the reservation, if permitted by the Host, may result in a surcharge to the Host at the regular price, i.e., without the Discount.
  4. Discounts available to Participants are expressed as a percentage and reduce the value of the remuneration paid to the Host for the reservation made; Discounts do not apply to other fees such as service charges.
  5. One Participant may only use the Discounts for one reservation unless it is expressly allowed to accumulate Discounts or combine them with other promotions.
  6. Discounts are granted individually by the Host, so their amount may vary depending on the current offer.
  7. AlohaCamp will inform the Participant of a reservation that qualifies for a Discount through a special notice on the platform.

§4 Complaints

  1. A participant may file a complaint in the following manner: in person at AlohaCamp's headquarters or in writing to the address of AlohaCamp's office or by email at: hello@alohacamp.com.
  2. The filing of a complaint should take place, if possible, as soon as the Participant becomes aware of the occurrence of the objectionable circumstances, to enable its consideration by AlohaCamp.
  3. AlohaCamp will consider complaints immediately, but no later than within 14 days of receipt. In case of a justified inability to respond within the indicated period, it may be extended, during which time AlohaCamp will inform the complainant.
  4. The answer to the complaint will be provided in documentary form or in another agreed manner.

§5. Processing of personal data

  1. Under the Regulation of the European Parliament and of the Council (EU) 2016/679 of April 27, 2016. (RODO), AlohaCamp informs that:
    1. AlohaCamp is the administrator of Participants' personal data
    2. Participant's personal data will be processed based on legitimate interests (Article 6(1)(f) RODO), to implement the provisions of the Program Regulations (Article 6(1)(b) RODO), including the fulfillment of obligations undertaken therein, and to establish, assert or defend against claims related to participation in the Program,
    3. as well as in connection with the need to comply with AlohaCamp's legal obligations under Union or Polish law (Art. 6(1)(c) RODO); personal data will also be processed based on consent (Article 6(1)(a) RODO) for marketing purposes;
    4. personal data of Program Participants will be stored for a period depending on the purpose for which they were collected, i.e. respectively for the duration of the Program, and after its termination - until the expiration of the statute of limitations for potential claims, and for the period of mandatory data storage indicated in the provisions of the Accounting Act;
    5. Program participants have the right to request access to the content of their personal data, rectification, erasure, restriction of processing, the right to data portability, and - for reasons related to their particular situation - the right to object to processing based on Article 6(1)(f), and the right to withdraw consent given based on Article 6(1)(a) of the DPA at any time without affecting the legality of processing carried out based on consent before its withdrawal.     6. Participants have the right to file a complaint to the Data Protection Commissioner, in case the processing of personal data is considered to violate personal data protection laws.

§6. Final Provisions

  1. In matters not regulated, the provisions of the Civil Code shall apply.
  2. Any disputes on the basis of the Regulations will be settled by the competent common court.
  3. AlohaCamp reserves the right to change the Regulations or terminate the Program at any time. This does not affect the rights acquired by Program Participants.
  4. The Regulations are available on AlohaCamp's website and at AlohaCamp's office.
  5. The Regulations become effective on 1.01.2025.
