Terms and conditions of the AlohaCamp Referral Programme

Β§1 Preliminary provisions

  1. These Terms and Conditions (the β€œTerms and Conditionsβ€œ) set out the rules for participation in the AlohaCamp Referral Programme (the β€œProgrammeβ€œ).

  2. The organiser of the Programme is AlohaCamp S.A. with its registered office in Warsaw, ul. PuΕ‚awska 77 lok U.5, 02-595 Warsaw, KRS number 0000922633 (β€œAlohaCampβ€œ or β€œOrganiserβ€œ).

  3. The Programme runs from 19.09.2022 until cancellation. AlohaCamp reserves the right to terminate the Programme at any time without giving any reason. This does not affect the vested rights of Programme Participants.

  4. The terms used below have the following meanings:

    1. Referrer - a natural person with full legal capacity using the alohacamp.com platform, declaring willingness to participate in the Program and meeting the requirements of Β§2.1,

    2. Referred User - an individual using the Referral who has received a Referral Code from the Referrer and, with the help of the Referrer, creates an account on the alohacamp.com platform and makes a booking for accommodation through this platform,

    3. Referred Host - a person who, using the Referral, who has received a Referral Code from the Referrer and using it, creates his/her Host account on the alohcamp.com platform and offers his/her travel or related services through it.

    4. Ambassador - a Referrer who has made at least 10 Referrals in accordance with Β§2(1).

    5. Referral - the transmission of the Referral Code by the Referrer to the Referred User,

    6. Referral Code - an individual code that the Referrer can find on the Programme website (https://alohacamp.com/referral-program) after logging into their account.

    7. User - an individual with an account on the alohacamp.com platform who can be both a Referrer and a Referral at the same time.

    8. Host - a person who offers their travel or related services on the alohcamp.com platform.

Β§2 Participation in the Programme and its rules

  1. A natural person with full legal capacity who fulfils all of the following conditions may participate in the Programme as a Referrer:

    1. has an active account on the alohacamp.com platform,

    2. accept these rules,

    3. will, during the duration of the Program, provide his/her Referral Code to the Referrer in accordance with paragraph 2,

    4. gives marketing consent to be contacted by the Organiser.

  2. A natural person may participate in the Programme as a Referred User if he/she jointly fulfils the following conditions:

    1. at the time of the referral by the Recommender does not have a user account on the alohcamp.com platform,

    2. will receive a Referral Code from the Referrer and use it to create a user account on the alohcamp.com platform,

    3. accept these rules.

  3. A natural person, a legal person or an organisational unit that jointly fulfils the following conditions may participate in the Programme as a Featured Host:

    1. at the time of the referral by the Referrer, there is no Host account on the alohcamp.com platform,

    2. will receive a Referral Code from the Referrer and use it to create a Host account on the alohcamp.com platform by entering into a service agreement with AlohaCamp,

    3. passes the verification conducted by the Organiser,

    4. its object will be published on the platform

    5. accept these rules.

  4. If the Referred User fulfils the conditions set out in the Terms and Conditions, the Referred User and the Referrer will receive the reward in accordance with Β§3.

  5. One Referrer may refer any number of Referred Users.

  6. Each Referred User may become a Referrer if he/she fulfils the requirements set out in the Terms and Conditions.

Β§3 Rewards

  1. Rewards for User Referrals

    1. The reward in the Programme for the referral of a User is a voucher worth 100 PLN / 20 EUR for the Referred User, which can be used within 3 months from the date of their assignment to the User's account to make the next booking on the aholacamp.com platform for an amount not less than 800 PLN / 170 EUR.

    2. The reward in the Programme for the referral of a User is a voucher worth 50 PLN / 10 EUR or 100 PLN / 20 EUR for the Referrer (according to the rules indicated in paragraphs Β§3 1.c. and Β§3 1.d.), which can be used within 3 months from the date of their assignment to the User's account.

    3. The Referrer receives a reward of 50 PLN / 10 EUR when, within 3 months of creating an account, the Referred User completes the first booking made via the alohacamp.com platform and the value of such a booking is between PLN 800 / 170 EUR and PLN 1199.99 / 259.99 EUR.

    4. The Referrer receives a reward of 100 PLN/ 20 EUR when, within 3 months of creating an account, the Referred User completes the first booking made via the alohacamp.com platform, and the value of such a booking will be 1,200 PLN / 260 EUR or more.

  2. Rewards for Host Referrals

    The rewards in the Programme for referring a Referred Host are vouchers to the value of 200 PLN / 40 EUR for the Referrer, which can be used to pay for the next accommodation booking on the alohacamp.com platform within 3 months from the date of their assignment to the User's account.

  3. Additional rewards for the Ambassador

    Becoming an Ambassador is combined with the granting of a package of discounts from AlohaCamp partners. In addition, if after a trip booked through the alohacamp.com platform, the Ambassador provides AlohaCamp with content in accordance with the guidelines sent via email and the Terms of Use of Content, AlohaCamp will grant the Ambassador a voucher worth 20 EUR to be used for bookings on the alohacamp.com platform, valid for 6 months from the date of issue.

  4. Common provisions

    1. The prizes provided by AlohaCamp on account of an effective Referral will constitute prizes related to bonus sales, which, pursuant to Article 21(1)(68) of the Act, enjoy exemption from income tax.

    2. AlohaCamp does not pay the equivalent of the prize in cash or any other form. The prize cannot be exchanged for material things.

    3. Delivery of the voucher will be made by assigning it to the user's account on the alohacamp.com platform.

    4. AlohaCamp reserves the right to verify Referred Users and Referred Hosts. In the event that AlohaCamp receives probable information that the Referrer or Referred User or Referred Host is using the Program in a manner that violates the law, rules of social coexistence or is contrary to good manners or generally applicable social norms, or sends Referrals to strangers who have not consented to receive them, AlohaCamp reserves the right to exclude the Referrer from the Program. In such a situation, the Referrer forfeits the right to receive the Voucher, regardless of whether he/she fulfils the other conditions set out in the Terms and Conditions.

Β§4 Complaints

  1. The Referrer or Referred User or Referred Host may lodge a complaint as follows: in person at AlohaCamp's registered office or in writing to AlohaCamp's registered office address or by emailing hello@alohacamp.com.

  2. A complaint should be made, as soon as possible after becoming aware of the circumstances giving rise to the concern, in order to enable AlohaCamp to deal with it.

  3. AlohaCamp shall consider complaints immediately, but no later than within 30 days of receipt. If it is reasonably not possible to respond within the indicated period, this period may be extended, of which AlohaCamp will inform the complainant.

  4. The response to the complaint will be provided in documentary form or by other agreed means.

Β§5 Processing of personal data

  1. In accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016. (RODO), AlohaCamp informs you that:

    1. AlohaCamp is the controller of the personal data of the participants in the Programme;

    2. the Referrer's personal data will be processed on the basis of a legitimate interest (Art. 6(1)(f) RODO), for the purpose of implementing the provisions of the Regulations of the Programme, including the fulfilment of the obligations undertaken therein and for the purpose of establishing, investigating or defending against claims related to the participation of the Referrer in the Programme, as well as in connection with the necessity of fulfilling AlohaCamp's legal obligations under Union or Polish law (Art. 6(1)(c) RODO);

    3. personal data will also be processed on the basis of consent (Article 6(1)(a) RODO) for marketing purposes;

    4. personal data of Programme participants will be stored for a period depending on the purpose for which it was collected, i.e. respectively for the duration of the Programme, and after its termination - until the expiry of the limitation period for potential claims and the period of mandatory data storage indicated in the provisions of the Accounting Act;

    5. Programme participants have the right to request access to the content of their personal data, their rectification, erasure, restriction of processing, the right to data portability and, for reasons related to their particular situation, the right to object to processing on the basis of Article 6(1)(f), and the right to withdraw consent given on the basis of Article 6(1)(a) RODO at any time without affecting the lawfulness of the processing carried out on the basis of consent before its withdrawal.     6. Participants in the Programme have the right to lodge a complaint with the President of the Office for Personal Data Protection if they consider that the processing of their personal data violates the legal provisions on personal data protection;

Β§6 Final provisions

  1. In matters not regulated, the provisions of the Civil Code shall apply.

  2. Any disputes arising from the Rules shall be settled by the competent common court.

  3. AlohaCamp reserves the right to change the Terms and Conditions or to terminate the Programme at any time. This does not affect the acquired rights of Programme Participants.

  4. The regulations are available on the AlohaCamp website and at the AlohaCamp headquarters.
